COVENANT ENFORCEMENT Any resident can initiate a confidential complaint and any board member can issue a citation. Once a month, the BOD will inspect the property for violations, review complaints and hear appeals. Residents are entitled to the due process steps outlined in our bylaws.
FINE SCHEDULE The Board of Directors has adopted the following fine schedules effective January 1st, 2018.

Maintenance - Lawn maintenance and care is your responsibility. If you wish to plant flowers, shrubs or trees it is your responsibility to maintain and water them.
Pets - Pets are allowed, however please clean up after your pets. All pets must be on a leash when you walk them. This will be heavily enforced by the Board, Violators will be fined. Our Covenant clearly states: No Breeding of Pets within our community. Trash -Trash is picked up early Wednesday morning. Please place trash in the containers provided by Fairburn Utilities near the sidewalk after sundown Tuesday. Recycle boxes are also provided by Fairburn Utilities, and also are to be placed near the sidewalk Wednesday evening. Recycled items are picked up each Thursday. You must contact Fairburn Utilities if you need to have bulk items picked up. Please place trash receptacles out of view when not in use. Trash cans, Nor constructing materials cannot be placed in front of your Garage doors. Trash cans go in the back of your property if trash cans are seen in the front area of your property you will get a warning letter and if it continues a fine will follow. Vehicles - Your vehicles should be parked in the garage with the garage door closed when not in use, or in your driveway. No street parking is allowed except when you have guests. Blocking the sidewalks are prohibited, 2 to 3 vehicles can be park in driveway. But can not block the sidewaks. You will be be fined by the Board and Code Enforcement Department. Children of Asbury Park please move out of the way of moving vehicles coming in or out of the subdivision. Property Modification - Plans for additions or improvements to the outside of your home such as constructing a fence must be approved by the Board of Directors/Architectural Control Committee. The Board of Directors must approve any additions or improvements that may affect the exterior of the houses. This includes fence building, siding, brick, window trim, certain restrictions regarding vehicles and general appearance. All fences or property additions must meet the Asbury Park requirements and be approved by the board. Please contact us for a Request for Property Modification Form. Leasing - All offsite owners must apply for a leasing permit 60 days prior to their leasing permit expiration date. (e-mail the BOD for an application), submit a copy of their lease (with our leasing provisions added) and supply their tenants with a copy of our Rules & Regulations Tenants do not receive a copy of our Covenants or Bylaws. Current owners will have their leasing permits approved if they are current on their dues and if we are below our Leasing Cap and the Board of Directors now ask that property managers do a complete background check on their new tenants. You must meet the requirement of payment of all dues first before a lease permit is approved or granted. Those who fail to do so will be referred to the association attorney for suit. As of August 25, 2015 The Board of Directors would like to inform all homeowners if they are interested in leasing their home they may apply for a leasing permit but at this time we are at our 25% Rental Cap and will no longer be accepting Leasing Applications. What we can do is place your application, name and contact information on our Asbury Park Lease Permit Waiting List and you can contact Keith Williams at Heritage Property Management at kwilliams@heritageproperty.com for any availabilities. Please be aware request must be in writing so that management has a record of homeowners leasing their propertites. As for hardship leasing this will be approved but only at the discretion of the Board. You must request a hardship leasing permit from the Board in writing. If any homeowner is leasing their property without the Boards approval and/or leasing permit they will be referred to the Associations Attorney for litigation, and breach of our covenants and your tenants will be removed from the property without further notice. If any homeowner leases their home without the approval of the Board of Directors and allows the new tenants to move in to their property without the boards approval the homeowner will be fined $1000.00 and then $25.00 A DAY UNTIL THE TENANT EITHER MOVES OUT OR IS EVICTED NO EXCEPTIONS. IF YOU FAIL TO ABIDE WITH PARAGRAPH 12 OF THE COVENANTS, YOU WILL HAVE TO PAY FINES, ATTORNEY’S FEES, COURT COST AND YOUR TENANT WILL BE EVICTED. Our Property Manager will be requesting information from the homeowners currently leasing their property for updated information. Remember The Board will only allow leasing from year to year and the homeowner must renew their lease perrmit at least 60 days prior to your lease expiration. |
